Biden Offers to Subsidize State Lawbreakers With Federal Dollars

( – On Wednesday, August 18, President Joe Biden spoke to reporters about Afghanistan. As he often does, the president went off on a tangent about Republican governors and anti-mask initiatives. In particular, one line in the speech is breathtaking and deeply troubling.

The president purposely advocated for the federal government to violate the US Constitution. It’s par for the course, right? However, this is different. Biden offered to use federal dollars to indemnify people who break state laws regarding mask mandates, even those laws upheld by the courts.

Biden Promises to Protect School Administrators and Teachers Who Defy State Laws

During the 2020 presidential campaign, then-Democratic candidate Joe Biden often tried to excoriate President Trump as a lawless chief executive. Yet, as of now, Biden is the most lawless president in modern US history. His administration continues to rack up court losses against unconstitutional policies on several issues including immigration, racial discrimination in the release of federal funds, oil and gas leases, federal eviction moratoriums, and the list goes on.

Now, this one quote from Biden’s Wednesday speech sounds new alarms:

“If a governor wants to cut the pay of the hard-working education leader who requires masks in a classroom, the money from the American rescue plan can be used to pay that person’s salary 100%.”

You read that correctly. Biden told teachers if they break state laws, he will pay their lost wages. Aside from how he would do that, this is a troubling Constitutional crisis in the making.

Constitutional Crises Emerging

At the risk of coming across as an exaggeration, this is not an inconsequential matter. The 10th Amendment to the US Constitution states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Neither education nor healthcare is a power granted to the federal government. It’s a state issue, and as such, each state oversees its own public health initiatives and educational mandates.

In Florida, Republican Gov. Ron DeSantis and the Florida Department of Education determined there will be no mask mandates in Florida public schools. In Texas, Republican Gov. Greg Abbott did the same. The state Supreme Court affirmed Abbott’s executive order and determined public schools were violating state law by implementing mask mandates in opposition to the governor.

These states believe the benefits of education without masks outweigh the risks of the virus. The law applies to all children and families equally. Not everyone agrees or likes it any more than people in states with mask mandates do, but it is the law in Florida and Texas. Parents always have the option to decide on the mask issue for their children.

So, here comes Biden with his disagreement. His solution is to entice state employees to break state law. He is offering federal funds to encourage violations of lawful state rules backed by the US Constitution and their respective state constitutions.

Just imagine, for one moment, what would happen if Texas offered to pay CBP employees to declined to carry out their duties over conscientious objections. What if a border agent refused to follow federal guidance to release illegal immigrants and instead followed Texas state guidance? There would be an immediate outcry that Texas attacked federal authority.

If federal authorities could infringe on states’ rights with impunity, why wouldn’t the reverse situation be okay?

For a very long time, the Supreme Court has held it’s unconstitutional to coerce or commandeer states to undermine state authority under the promise of federal guarantees. Biden is violating the principles and laws of federalism, i.e., the separation of the national government and state government.

Biden’s reckless promise should deeply concern every American because it’s a step too far in the wrong direction. Biden’s threat is the authoritarian type of action the president and Democrats unsubstantially accused Trump of taking. Here, with Biden, it’s open and in the public eye for all to see.
